I received an email alert from the Arizona Department of Real Estate (ADRE) that they have issued a cease and desist order against L&R Maintenance & Property Management<\/strong> for unlicensed activity. I’m very happy to see our Commissioner Judy Lowe going after these companies. Don’t get me wrong, I’m not rubbing salt into their wounds I’m just saying if you want to be a Property Manager<\/strong> then hire a licensed Real Estate Broker<\/strong> to run your office and then come do business on a level playing field with the rest of the\u00a0licensed\u00a0management companies<\/strong>.\u00a0<\/p>\n

Cease and Desist Order Issued-<\/strong><\/p>\n

T<\/strong>he Arizona Department of Real Estate (ADRE) issued a Cease and Desist Order and a Notice of Right to Request Hearing on August 29, 2011 to L&R Maintenance LLC dba L&R Maintenance<\/strong> and Property Management<\/strong>, an unlicensed entity and Lynda Carol Williams<\/strong>, an unlicensed individual.\u00a0 The Commissioner finds L&R and Williams are in violation of Arizona Revised Statutes and Arizona Administrative Codes.\u00a0 L&R and Williams conducted real estate activities in Arizona without holding a license to do so,\u00a0\u00a0 in violation of A.R.S. \u00a7\u00a732-2122 (B) and 32-2153 (B)(6).\u00a0 A.R.S. \u00a7 32-2165 provides \u201ca person who acts as a broker or salesperson within the meaning of Title 32, Chapter 20, or who advertises in a manner that indicates that the person is licensed as a broker or salesperson, without being licensed as\u00a0 prescribed by this chapter is guilty of a class 6 felony.\u201d\u00a0 Pursuant to A.R.S. \u00a732-2154, if it appears that any person has engaged, is engaging or is preparing to engage in any act, practice or transaction that constitutes a violation of Title 32, Chapter 20, the Department may issue an order directing any person to cease and desist from engaging in the act, practice or transaction or doing any act in furtherance of the act, to make restitution or to take appropriate affirmative action to correct the conditions resulting from the act, practice or transaction.<\/p>\n

\u00a0It is ordered that L&R and Williams immediately cease and desist<\/span><\/strong> <\/span>from engaging in any real estate activity, as defined by A.R.S. \u00a7 32-2101 et seq., as an individual, an employee, agent, officer, principal, or in any capacity whatsoever, directly or indirectly, within the State of Arizona, including but not limited to without first complying with all applicable\u00a0laws and rules.<\/p>\n

It is further ordered that this Cease and Desist Order shall be recorded in the offices of the Maricopa county Recorder within the State of Arizona.<\/p>\n","protected":false},"excerpt":{"rendered":"
